Contracting

Consultant mandate / SUBCONTRACTOR / B2B Business to Business

We conclude a service contract with you as a consultant. As a contractor, you invoice us via your own limited liability company (GmbH) or stock corporation (AG) where you are employed. You issue your monthly invoice to GHR based on the agreed hourly rate plus VAT. GHR settles the account with the client on the basis of your invoice.

As a service provider from the EU/EFTA area, you have the right to offer services in Switzerland without a licence for 90 effective working days per calendar year. You merely need to provide advance notice (see https://meweb.admin.ch/meldeverfahren/). For compliance reasons, cooperation with international service providers can only take place via a limited liability company (GmbH) or stock corporation (AG). However, if you, as a freelancer or sole trader, have a company tax number and Form A1 from your home country and can provide confirmation that you pay the statutory social security contributions correctly in your home country, a cooperation can be considered.

If the project requires more than 90 effective working days per calendar year and the services cannot be provided remotely, Swiss residence and work permits will be required! As such permits are subject to cantonal quotas and there is no right to be granted a permit, it is worth considering the options at an early stage. There are a number of possible solutions available, such as:

  1. Establishing a branch of your foreign company in Switzerland
  2. Establishing a Swiss GmbH or AG
  3. Transferring to an employee leasing mandate, including employment with GHR (with payment of a salary)

As a former freelancer or employee, you will be employed by us at an hourly or monthly wage. We will then assign you to work temporarily for the customer. With this arrangement, you will be forced as an employee into participating in mandatory Swiss social insurance. GHR calculates the hourly rate charged to the customer as follows Example:

GHR retail rate per hour = total cost (All in)

100.00

Less employer social insurance contributions

-13.00

Gross hourly rate.

87.00

Less employee social insurance contributions.

-11.82

Net hourly rate (Withholding tax deductions were not taken into account in the above example and are also deducted from the gross hourly rate. The pension fund deduction was calculated on the basis of 1970 and can vary greatly depending on age.)
